Terms of Service

Agreement & Acceptance

By using our website, requesting a quote, scheduling service, or engaging Buffalo Ridge for fencing and/or decking work, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the site or our services.

Estimates, Scope & Site Verification

• Free quotes. Initial quotes are based on information you provide and may be subject to on-site verification and measurement.
• Final scope governs. The written estimate/invoice describes the materials, layout, height/length, gates, hardware, and any add-ons included.
• Subsurface/hidden issues. If unforeseen conditions are discovered (e.g., rock, roots, buried debris, grade changes), we will discuss options and any price/time adjustments before proceeding.

Scheduling, Access & Delays

• Access. You agree to provide clear access to the work area and to secure pets/children during working hours.
• Weather & supply. Dates are estimates and may shift due to weather, permitting, inspections, supply chain, or other factors outside our control.
• Rescheduling. If a delay occurs, we will promptly communicate and reschedule the work as soon as practicable.

Customer Responsibilities

• Property lines & HOA. You are responsible for confirming property boundaries and obtaining any HOA approvals or neighborhood restrictions. We can assist with drawings or specs upon request.
• Permits. If permits are required, you agree to obtain them unless our estimate expressly states we will do so.
• Utilities. We will request public utility locates where required/applicable. You are responsible for locating/marking private lines and systems (e.g., sprinklers, lighting, dog fences, drain tile).

Materials, Standards & Warranties

• Installation standards. Work is performed in a professional manner consistent with industry practices and manufacturer instructions.
• Natural materials. Wood is a natural product and may include normal variations (grain, knots, color) and may move over time (shrink/expand, check, cup); this is not a defect.
• Manufacturer warranties. Any manufacturer warranties for materials apply as provided by the manufacturer.
• Workmanship. Any workmanship assurance will be stated on your estimate/invoice and is subject to proper maintenance and normal use.

Payments & Invoices

• Payment schedule. Deposit and remaining payment terms are as stated on your estimate/invoice.
• Due on completion. Final payment is due upon substantial completion unless otherwise specified.
• Non-payment. We may suspend work or withhold materials in the event of non-payment as permitted by law and the estimate/invoice.

Changes & Additional Work

Any change to materials, layout, footage, gates, staining, or add-ons must be approved. Approved changes may require a written change order and may affect price and schedule.

Site Conditions & Property

• Care of property. We take reasonable care to minimize disturbance. Normal construction impacts (e.g., foot traffic, soil displacement near posts) may occur.
• Existing conditions. We are not responsible for pre-existing issues including grading, drainage, erosion, or unstable soils.

Cancellations & Special Orders

• Schedule changes. If you need to cancel or reschedule, please notify us as soon as possible.
• Custom materials. Custom/special-order materials may be non-returnable; you are responsible for costs actually incurred prior to cancellation, as allowed by law.

Electronic & SMS Communications

Consent to texts. By providing your phone number, you expressly consent to receive text messages from Buffalo Ridge Fence & Deck regarding your inquiries, appointment scheduling, service updates, and other relevant communications. Message frequency may vary depending on your interactions with us. Message and data rates may apply.

Opt-out. To stop receiving messages at any time, reply STOP. No further messages will be sent.

Photos, Reviews & Portfolio Use

We may photograph completed work for our portfolio, social media, or marketing. We will not publish personally identifying details without your permission. If you prefer we do not photograph your project, please tell us before completion.

Website Use & Disclaimers

• Informational content. Site content (including pricing examples, blog posts, and FAQs) is for general information and may change without notice.
• No guarantees. While we work hard to provide accurate information, we do not guarantee that the website will be error-free or uninterrupted.
• Third-party links/tools. Any third-party sites or tools are subject to their own terms and privacy policies.

Limitation of Liability

To the maximum extent permitted by law, Buffalo Ridge and its owners, employees, and subcontractors will not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim related to our services is limited to the amounts you paid for the specific services giving rise to the claim.

Governing Law

These Terms are governed by the laws of the State of Nebraska, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction and venue of state and federal courts located in Nebraska for any dispute arising out of these Terms or our services.

Changes to These Terms

We may update these Terms from time to time. The “Effective date” above reflects the latest version. Your continued use of our site or services after changes become effective constitutes acceptance of the revised Terms.
